JUDITH SMITH F/K/A JUDITH GOODRUM, Appellant v. DAVID EUGENE GOODRUM, SR., Appellee

On Appeal from the 312th District Court

Harris County, Texas

Trial Court Cause No. 1992-46409

MEMORANDUM OPINION

Appellant, Judith Smith f/k/a Judith Goodrum, has failed to timely file a brief. See TEX. R. APP. P. 38.6(a) (governing time to file brief), 38.8(a) (governing failure of appellant to file brief). Appellant's brief was first due on January 20, 2012. The Court granted an extension until February 20, 2012. On March 27, 2012, the Court notified appellant that this appeal was subject to dismissal if appellant failed to file a brief by April 6, 2012. On April 28, 2012, appellee filed a motion to dismiss the appeal for want of prosecution. Appellant did not respond.

We grant appellee's motion and dismiss the appeal for want of prosecution for failure to timely file a brief. See TEX. R. APP. P. 42.3(b) (allowing involuntary dismissal of case).

We dismiss any pending motions as moot.

PER CURIAM

Panel consists of Justices Higley, Sharp, and Huddle.
