Jade P Smith v. Justin Matthew Gardner

LC No. 20-001919-NI

ORDER

Elizabeth L. Gleicher, Chief Judge, acting under MCR 7.203(F)(1), orders:

The claim of appeal is DISMISSED for lack of jurisdiction because the January 11, 2022 judgment is a consent judgment and does not include any provision allowing for an appeal as to certain issues. A party that agrees to the entry of a judgment is not an aggrieved party and cannot appeal the judgment. MCR 7.203(A); Kocenda v Archdiocese of Detroit, 204 Mich.App. 659, 666; 516 N.W.2d 132 (1994).
