JUDGMENT


This case has been dismissed without prejudice for failure to prosecute and failure to notify the court of address change. Judgment in favor of defendants and against plaintiff is accordingly entered.

IT IS SO ORDERED AND ADJUDGED.

DISMISSAL FOR FAILURE TO PROSECUTE AND FAILURE TO NOTIFY COURT OF ADDRESS CHANGE

This Court has reviewed de novo the files and records in this case, and the Report and Recommendation issued by Magistrate Judge Maria-Elena James. This Court concurs in Judge James' findings and analysis; and finds that plaintiff Frederick E. Smith has failed properly to prosecute this action in violation of Federal Rule of Civil Procedure 41(b) and has failed to notify the Court of his current address in violation of Local Rule 3-11.

Accordingly, this action is DISMISSED WITHOUT PREJUDICE.

IT IS SO ORDERED.
