REPORT AND RECOMMENDATION

This cause is before the court upon referral from the clerk. Plaintiff commenced this action by filing a civil rights complaint under 42 U.S.C. § 1983 (ECF No. 1). By order of this court dated March 9, 2017, Plaintiff was given thirty (30) days in which to file an amended complaint (ECF No. 7). Plaintiff failed to file an amended complaint by the deadline; therefore, on April 17, 2017, the court issued an order requiring Plaintiff to show cause, within thirty (30) days, why this action should not be dismissed for failure to comply with an order of the court (ECF No. 8). The copy of the show cause order mailed to Plaintiff was returned to the court by the Escambia County Jail (Plaintiff's address of record when he filed his complaint) marked "Return to Sender; Released on 3/30/17" (see ECF No. 9). As of the date of this Report, Plaintiff has not filed an amended complaint or explained his failure to do so. Additionally, Plaintiff has failed to keep the court apprised of his current address.

Accordingly, it is respectfully RECOMMENDED:

That this case be DISMISSED without prejudice for Plaintiff's failure to comply with an order of the court.
