GARY SMITH, Appellant, v. EL PASO VETERANS TRANSITIONAL LIVING CENTER, Appellee.
Appeal from the County Court at Law No. 3 of El Paso County, Texas (TC# 2017-CCV00770) ORDER
On August 21, 2017, the Court filed Appellant's motions requesting an extension of time to challenge the trial court's indigency determination and requesting that he be excused from paying costs on appeal. The clerk's record contains an order from the trial court sustaining the court's reporter's contest to Appellant's Statement of Inability to Pay Costs on Appeal. The Court has construed Appellant's motion as a challenge to the trial court's order pursuant to Rule 145(g) of the Texas Rules of Civil Procedure. Appellant did not timely file his Rule 145(g) motion, but he has requested an extension of time as permitted by Rule 145(g)(2). Appellant's motion for an extension of time in which to file a motion challenging the trial court's order sustaining the court's reporter's contest is GRANTED. By rule, the court reporter is required to prepare the record of the hearing on the court reporter's contest without charge to Appellant. Tex.R.App.P. 145(h). The reporter's record of the hearing is due to be filed no later than September 1, 2017
IT IS SO ORDERED this 22nd day of August, 2017.
