On April 29, 2022, respondent filed a motion to dismiss for failure to properly prosecute. Petitioner has not responded to respondent's motion despite the Court's May 4, 2022 order that petitioner show cause why that motion should not be granted on or before June 8, 2022, or the Court's June 15, 2022 order extending the time for petitioner's response to June 29, 2022. Upon due consideration, it is

ORDERED that respondent's above-referenced motion is set for hearing during the Court's Dallas, Texas, trial session scheduled to begin at 10:00 a.m. on September 6, 2022, at the Earle Cabell Fed. Bldg. & U.S. Courthouse, 1100 Commerce Street, Room 726, Dallas, Texas 75242. It is further

ORDERED that the Clerk of Court is directed to serve on the parties a copy of the Court's Standing Pretrial Order for the September 6, 2022, Dallas, Texas, trial session. It is further

ORDERED that the Clerk of the Court shall send with petitioner's copy of this Order: (1) a copy of respondent's motion and (2) a clinic letter for Dallas, Texas.

Petitioner is advised that failure to appear at the hearing on September 6, 2022, may result in the Court granting respondent's motion and entering an order and decision against petitioner. The Court does not anticipate granting any further continuances in this case.
