This case was called from the calendar at the Court's Denver, Colorado session, conducted remotely on October 25, 2021 for hearing on respondent's Motion to Dismiss for Lack of Prosecution filed October 1, 2021. There was no appearance by or on behalf of petitioner. Counsel for respondent appeared and informed the Court that someone other than the petitioner had signed petitioner's name on the Proposed Stipulated Decision filed on October 13, 2021. On January 10, 2022, the Court received from the parties a revised Proposed Stipulated Decision in which the Court intends to enter into the record.

Upon due consideration and for cause, it is

ORDERED that respondent's Motion to Dismiss for Lack of Prosecution filed October 1, 2021, is hereby denied as moot.
