On October 17, 2023, the Court held a teleconference with the parties to discuss the status of the case. Petitioner's counsel stated that he will be providing additional documentation to respondent's counsel by October 18, 2023.

Upon due consideration, it is

ORDERED that respondent's October 3, 2022 Motion to Dismiss for Failure to Properly Prosecute (Doc. 8) is denied. It is further

ORDERED that jurisdiction of this case is no longer retained by the Undersigned and this case is restored to the general docket for trial or other disposition.
