Robert Smith & Joy Smith Petitioners v. Commissioner of Internal Revenue Respondent

ORDER TO SHOW CAUSE

Cary Douglas Pugh, Judge

This case is currently set for trial at the Court's November 1, 2021, Miami, Florida Trial session. On September 10, 2021, petitioners filed a Motion for Leave to Amend Petition, advising that respondent does not object and lodged a document titled "Amended Petition". The Court also notes that both petitioners are represented by the same attorney, Ross M. Greenberg, which appears to be a conflict of interest. See Rule 24(g), Tax Court Rules of Practice and Procedure. Upon due consideration and for cause, it is hereby

ORDERED that petitions' Motion to Amend Petition, filed September 10, 2021, is granted. It is further

ORDERED that petitioners' Amended Petition, lodged September 10, 2021, is retitled "Amendment to Petition", and filed as of the date of this Order. It is further

ORDERED that on or before October 13, 2021, petitioners shall show cause in writing why their counsel of record, Ross M. Greenberg, would not have conflicts of interest if the Court were to allow him to serve as counsel for both petitioners. It is further

ORDERED that in addition to regular service of this Order, the Clerk of the Court shall serve a copy on petitioners at their addresses of record.
