MOTION DECISION

PRESENT: WHALEN, P.J., SMITH, CENTRA, PERADOTTO, AND CARNI, JJ.

Petitioner-appellant having moved for permission to proceed as a poor person and for assignment of counsel on the appeal taken herein from an order of the Family Court, Oswego County, entered July 6, 2021,

Now, upon reading and filing the papers with respect to the motion, and due deliberation having been had thereon, It is hereby ORDERED that the notice of appeal, filed June 8, 2021, shall be treated as valid as to the order of Family Court entered July 6, 2021, and

It is further ORDERED that the motion is granted, and

It is further ORDERED that Stephanie R. DiGiorgio, Esq., 2103 Genesee Street, Utica, New York 13501, is hereby assigned as counsel to conduct the appeal, and

It is further ORDERED that the Oswego County Family Court Clerk provide Stephanie R. DiGiorgio, Esq., with copies of all papers and transcripts of stenographic, digitally recorded, or audiotaped minutes, if any, of the proceedings upon which the appeal is based, and

It is further ORDERED that the record and briefs are to be filed and served within 60 days of the filing of the transcripts with the Oneida County Family Court Clerk.
