Smira v. Roper

Appellate Division of the Supreme Court of New York, First Department
Feb 25, 2003
302 A.D.2d 305 (N.Y. App. Div. 2003)

Opinion

285

February 25, 2003.

Order, Supreme Court, New York County (Alice Schlesinger, J.), entered April 25, 2002, which, in an action for legal malpractice, granted defendants' motion to dismiss the complaint, unanimously affirmed, with costs.

Mitchell B. Reiter, for plaintiff-appellant.

Steven B. Prystowsky, for defendants-respondents.

Before: Nardelli, J.P., Mazzarelli, Rosenberger, Ellerin, Gonzalez, JJ.

The unappealed order recognizing defendants' charging lien, entered in the underlying action in which defendants were discharged by plaintiff, bars plaintiff's claim of malpractice as a matter of law (Molinaro v. Bedke, 281 A.D.2d 242; Siegel v. Werner Zaroff, 270 A.D.2d 119).

THIS CONSTITUTES THE DECISION AND ORDER OF THE SUPREME COURT, APPELLATE DIVISION, FIRST DEPARTMENT.
