ORDER OF CLOSE OUT


On August 23, 2005, the plaintiff in the above action filed a notice of voluntary dismissal with prejudice pursuant to Federal Rule of Civil Procedure 41(a)(1)(ii). There being nothing further for the court to resolve, it is hereby ORDERED and ADJUDGED that:

1. Any pending motions not otherwise ruled upon are DENIED AS MOOT.

2. The Clerk of the Court shall enter the case as CLOSED. DONE and SIGNED.
