CRAIG SMITH, JUSTICE

On October 25, 2021, we suspended the deadline for filing appellees' brief after being informed the parties could potentially settle their dispute. Since then, the parties have verbally reached an agreement and begun the process of drafting a formal settlement agreement.

By joint status report filed February 7, 2022, the parties ask that we abate the briefing deadline another thirty days to allow them the opportunity to finalize their agreement. We GRANT the request and ORDER a motion to dismiss or appellees' brief be filed no later than March 9, 2022. Because this appeal has been pending in the Court since March 4, 2021, we caution that further requests to continue the abatement of the briefing deadline will not be granted absent exigent circumstances and that failure to file either a motion to dismiss or appellees' brief may result in the appeal being submitted on appellant's brief alone.
