ORDER

BENJAMIN H. SETTLE, United States District Judge

Having reviewed the Report and Recommendation of the Honorable Brian A. Tsuchida, United States Magistrate Judge, any objections or responses to that, and the remaining record, the Court finds and ORDERS:

(1) The Court ADOPTS the Report and Recommendation.
(2) The Court DECLINES to serve the Amended Complaint. Dkt. 19.
(3) The Court DISMISSES this action with prejudice for failure to state a claim upon which relief may be granted. 28 U.S.C. §§ 1915(e)(2)(B)(ii), 1915A(b)(1).
(4) The Court DENIES Plaintiff's motions for a temporary restraining order and a preliminary injunction. Dkts. 5, 16.
(5) The Clerk is directed to send copies of this Order to the parties and to Judge Tsuchida.
