This case is on the Court's March 6, 2023 trial calendar for Richmond, Virginia (Charlottesville). On February 13, 2023, respondent filed a Motion to Dismiss for Lack of Prosecution (Doc. 10) and a duplicate motion (Doc. 9).

Upon due consideration, it is

ORDERED that respondent's Motion to Dismiss for Lack of Prosecution (Doc. 9) is stricken from the docket record. It is further

ORDERED that respondent's Motion to Dismiss for Lack of Prosecution (Doc. 10), is set for hearing at the calendar call of the aforementioned session of the Court, at 10:00 AM (ET). Petitioner is advised that failure to comply with the terms of this Order or failure to appear at the hearing on March 6, 2023, may result in the Court granting respondent's motion and entering an order and decision against petitioner.

This Order constitutes official notice to the parties.
