April 25, 1950.

Present — Peck, P.J., Glennon, Dore, Cohn and Van Voorhis, JJ.


Order unanimously modified so as to provide that item "(b)" of the examination before trial of defendant shall read as follows: "(b) All matters pertaining to any business or financial dealing, including traffic interchange agreements, between the two defendants relating to the Kansas City, St. Louis and Chicago Railroad Company from January 1, 1945 to date," and, as so modified, affirmed. No opinion. The date for the examination to proceed shall be fixed in the order. Settle order on notice.
