In an action by the assignee of a wife to recover moneys allegedly due pursuant to a marital separation agreement between the wife and the defendant, who was then her husband, plaintiff appeals from an order of the Supreme Court, Kings County, entered August 31, 1961, denying her motion for summary judgment pursuant to rules 113 and 114 of the Rules of Civil Practice. Order affirmed, with $10 costs and disbursements. No opinion. Nolan, P.J., Ughetta, Christ, Pette and Brennan, JJ., concur.
