PROPOSED ORDER

The Court, having reviewed the report and recommendation of Chief Magistrate Judge J. Richard Creatura, objections to the report and recommendation, if any, and the remaining record, orders the following:

(1) The Court adopts the report and recommendation;

(2) Defendants' motions to dismiss (Dkts. 61, 63) are granted in part;

(3) Plaintiff's action is dismissed without prejudice;

(4) The Clerk is directed to send a copy of this order to plaintiff and Judge Creatura.
