ORDER

Joseph W. Nega, Judge.

This case was called from the calendar on September 6, 2022, at the in-person trial session of the Court in Fresno, California. Petitioner and counsel for respondent each appeared and filed a signed Proposed Stipulated Decision with the Court.

On August 15, 2022, respondent filed a Motion to Dismiss for Failure to Properly Prosecute (respondent's motion). By Order issued August 19, 2022, the Court ordered that, on or before August 31, 2022, petitioner shall file a response to respondent's motion and set respondent's motion for hearing during the Court's September 6, 2022, trial session. Petitioner did not file any such response to respondent's motion.

For cause and appearing fully in transcript of this proceeding, it is

ORDERED that respondent's Motion to Dismiss for Failure to Properly Prosecute, filed August 15, 2022, is denied as moot.
