The above-captioned matter is held in abeyance pending the outcome of the petition for rehearing and the suggestion for rehearing en banc in Carr v. Reno, No. 01-2270, 2002 WL 241444 (2d Cir. Jan. 4, 2002). This matter is to be transferred to the suspense docket pending further order of this Court.
