Appellant having moved to vacate the dismissal of the appeal taken herein from a judgment of the Supreme Court entered in the Office of the Clerk of the County of Monroe on February 22, 2013,

Now, upon reading and filing the affidavit of Willie Singleton sworn to June 19, 2013, the notice of motion with proof of service thereof, and the affirmation of Harold A. Kurland, Esq., dated July 2, 2013, and due deliberation having been had thereon,

It is hereby ORDERED that the motion is denied with leave to renew upon making a new motion that includes, among other things, an affidavit demonstrating a reasonable excuse for delay and an intent to perfect the appeal within a reasonable time.
