ORDER DISMISSING PETITION FOR WRIT OF MANDAMUS OR PROHIBITION

Petitioner has filed a notice with this court indicating that the petition has become moot based on a decision by the district court. As a result, petitioner seeks to withdraw his petition. We construe petitioner's filing as a motion seeking voluntary dismissal of the petition and we grant petitioner's request and dismiss the petition. NRAP 42(b). The parties shall bear their own costs and attorney fees.

It is so ORDERED.
