This case is calendared for a remote trial at the session of the Court scheduled to commence on February 27, 2023, for cases in which Portland, Oregon, is the place of trial.

On February 2, 2023, at 11:40 a.m., respondent filed a pretrial memorandum. On the same day, at 4:15 p.m., respondent filed a pretrial memorandum. Additionally, on February 2, 2023, respondent contacted the chambers of the undersigned and represented that the pretrial memorandum filed at 11:40 a.m. was an incomplete filing and that the revised pretrial memorandum filed at 4:15 p.m. was the complete and accurate filing. Accordingly, the Court will strike respondent's pretrial memorandum filed February 2, 2023, at 11:40 a.m.

For cause, it is

ORDERED that respondent's pretrial memorandum February 2, 2023, at Docket Index No. 11, is hereby stricken from the record.
