Sims v. State

District Court of Appeal of Florida, Third District
Oct 26, 1993
624 So. 2d 365 (Fla. Dist. Ct. App. 1993)

Opinion

No. 92-1976.

September 21, 1993. Rehearing Denied October 26, 1993.

An Appeal from the Circuit Court for Dade County; David Tobin, Judge.

Lazarus Fisher and Peggy Fisher, Coconut Grove, for appellant.

Robert A. Butterworth, Atty. Gen., and Stephanie G. Kolman, Asst. Atty. Gen., for appellee.

Before FERGUSON, COPE and GODERICH, JJ.

After an examination of the record we cannot conclude that the trial court's finding, that the defendant willfully violated a condition of probation, and its modification of the condition, constituted an abuse of discretion. Archer v. State, 604 So.2d 561 (Fla. 1st DCA 1992).

Affirmed.
