Sims v. State

District Court of Appeal of Florida, Fifth District
Feb 4, 1994
630 So. 2d 1251 (Fla. Dist. Ct. App. 1994)

Opinion

No. 93-945.

February 4, 1994.

Appeal from the Circuit Court for Lake County; Jerry T. Lockett, Judge.

James B. Gibson, Public Defender and Susan A. Fagan, Asst. Public Defender, Daytona Beach, for appellant.

Robert A. Butterworth, Atty. Gen., Tallahassee, and Carmen F. Corrente, Asst. Atty. Gen., Daytona Beach, for appellee.

Sims appeals the sentence imposed following his violation of probation. We find no merit in his various points on appeal except his contention that the trial court failed to award him credit for time served. In that regard, the State concedes error.

REVERSED and REMANDED.

HARRIS, C.J., and GOSHORN and THOMPSON, JJ., concur.
