STIPULATION AND ORDER DISMISSING CASE WITH PREJUDICE


Pursuant to Fed.R.Civ.Proc.41(a), plaintiff James A. Sims, Jr. hereby dismisses, with prejudice, this action and all his claims against defendant Octagon Marketing and Athlete Representation, Inc. Accordingly, pursuant to Fed.R.Civ.P.41(a) and Civil L.R. 7-11, and good cause appearing therefor, the parties hereby agree and stipulate as follows:

1. This action is dismissed in its entirety, with prejudice.

2. Each party to bear its own costs.

PURSUANT TO STIPULATION, IT IS SO ORDERED.
