Opinion
No. 1D00-2298.
Opinion filed September 1, 2000.
An appeal from the Circuit Court for Taylor County; James Roy Bean, Judge.
Gary J. Anton and Stephen L. Spector of Stowell, Anton Kraemer, Tallahassee, and W. Dexter Douglass of Douglass, Cooper, Coppins, Tallahassee, for the Appellant.
Gregory Stuart Parker of Smith, Smith Parker, Perry, and Michael F. Coppins of Cooper, Coppins Monroe, Tallahassee, for the Appellee.
Having considered the appellant's response to the Court's order dated July 17, 2000, the appeal is hereby dismissed for lack of jurisdiction. The appellant's counterclaims involve the same transaction as the complaint; as such, they are compulsory. Compulsory counterclaims are not appealable until final disposition of the complaint. See Campbell v. Gordon, 674 So.2d 783, 785 (Fla. 1st DCA 1996).
