COSTS, § 6unauthorized award of attorney's fees to successful defendant. Order awarding defendant attorney's fees and taxing the same as costs after there had been a judgment for defendant in action for alleged loss of laundry was unauthorized.

Appeal from the Municipal Court of Chicago; the Hon. HAROLD O'CONNELL, Judge, presiding.

Judgment affirmed; order awarding defendant attorney's fees as part of costs is reversed and costs in this court taxed against plaintiff. Heard in the first division, first district, this court at the October term, 1948.

Everett Simpson, pro se; no appearance for appellee.
