ORDER

Appellant is represented by appointed counsel, Kelly Ann Smith. On February 21, 2017, Smith filed a brief pursuant to Anders v. California, 386 U.S. 738 (1967), in which she concludes the appeal is wholly frivolous and without merit.

This court recently became aware that Smith has been suspended from the State Bar of Texas and is currently ineligible to practice law in Texas. Therefore, appellant is not currently represented by counsel.

Accordingly, the case is abated and remanded to the trial court with instructions to permit Kelly Ann Smith's withdrawal and appoint new counsel. The trial court is directed to have a supplemental clerk's record containing that appointment filed with the clerk of this court by June 9, 2017.

The appeal is abated, treated as a closed case, and removed from this court's active docket. The appeal will be reinstated on this court's active docket when the trial court's supplemental clerk's record is filed with this court.

New counsel may, but is not required to, file a supplemental brief, including a supplemental Anders brief.
