Supreme Court of Florida
Jul 18, 2024
No. SC2024-0714 (Fla. Jul. 18, 2024)

Opinion

SC2024-0714

07-18-2024

Lawrence Simpkins, Petitioner(s) v. Secretary, Dept. of Corrections, Respondent(s)

Lower Tribunal No(s).: 1D2023-0587; 372022CA001189XXXXXX

To the extent that Petitioner seeks to invoke the Court's all writs jurisdiction, the petition is dismissed for lack of jurisdiction because the Petitioner has failed to cite an independent basis that would allow the Court to exercise its all writs authority and no such basis is apparent on the face of the petition. See Williams v. State, 913 So.2d 541, 543-44 (Fla. 2005); St. Paul Title Ins. Corp. v. Davis, 392 So.2d 1304, 1305 (Fla. 1980). To the extent Petitioner seeks mandamus relief, because he has failed to show a clear legal right to the relief requested, the petition is hereby denied. See Huffman v. State, 813 So.2d 10, 11 (Fla. 2000). No rehearing will be entertained by this Court.

LABARGA, COURIEL, GROSSHANS, FRANCIS, and SASSO, JJ., concur.
