Judgment reversed upon the law and the facts, and a new trial granted, costs to abide the event, upon the ground that the evidence introduced by the plaintiff was sufficient to make out a cause of action under the allegations of the complaint. Kelly, P.J., Jaycox, Manning, Young and Kapper, JJ., concur.
