ORDER


This matter came on for hearing before the undersigned United States Magistrate Judge on May 27, 2004, on the motion of the Defendants to reopen the deposition of Brian Kunzler, for permission to take one additional deposition, and to compel the Plaintiff to prepare a modified privilege log. Based upon the memoranda of the parties, the arguments of counsel, and all the files, records, and proceedings herein, and for the reasons stated more particularly on the record in court,

IT IS HEREBY ORDERED that:

1. The Defendants' motion to reopen the deposition of Brian Kunzler is DENIED;

2. The Defendants' motion for permission to take one additional deposition is DENIED;

3. The Defendants' motion to compel the Plaintiff to prepare a modified privilege log is denied as MOOT. Defendants have agreed to provide the requested information in an updated privilege log.
