Interlocutory judgment reversed, with costs, and demurrer sustained with leave to amend the complaint upon payment of the costs of the demurrer and of this appeal. Held, that the complaint does not state facts sufficient to constitute a cause of action. All concurred, except Hardin, P.J., not sitting.
