Opinion

No. 2-178 / 01-0247.

Filed June 19, 2002.

Appeal from the Iowa District Court for Scott County, JOHN A. NAHRA, Judge.

Defendant appeals entry of permanent protective order. APPEAL DISMISSED.

Benjamin A. Yeggy, Davenport, for appellant.

James L. Ottesen of Scott County Domestic Abuse Special Prosecution Program, Davenport, for appellee.

Considered by HUITINK, P.J., and VOGEL and EISENHAUER, JJ.

Jerry Lee Siemonsma appeals from a permanent protective order entered pursuant to Iowa Code chapter 236. Because the protective order expired on December 27, 2001, this case no longer presents a justiciable controversy, and is moot. Perkins v. Bd. of Supervisors, 636 N.W.2d 58, 64 (Iowa 2001); In re Estate of Troester, 331 N.W.2d 123, 127 (Iowa 1983).

This case was transferred to the Court of Appeals on March 4, 2002.

APPEAL DISMISSED.
