Michael SHURIN, Plaintiff-Petitioner, v. BOARD OF EDUCATION OF HUDSON COUNTY SCHOOLS OF TECHNOLOGY, and Joseph M. Muniz in his official capacity as Board Secretary and Records Custodian of Hudson County Schools of Technology, Defendants-Respondents.


ORDER A petition for certification of the judgment in A-003716-20 having been submitted to this Court, and the Court having considered the same;

It is ORDERED that the petition for certification is denied, with costs. Plaintiff's claim for disclosure of the payment agreement between defendant Hudson County Schools of Technology (HCST) and the unnamed HCST employee was based on the Open Public Records Act, N.J.S.A. 47: 1A-1 to -13. The denial of certification is therefore without prejudice to any common-law right of access claim for disclosure of the payment agreement, or any claim for relief or theory of recovery based on HCST's failure to identify the unnamed HCST employee in the Resolution dated July 16, 2020 or the Settlement Agreement and Release between HCST and Graciela Rubet dated July 17, 2020.
