Shostakovich v. Twentieth Century-Fox Film Corp.

Appellate Division of the Supreme Court of New York, First Department
Mar 7, 1949
275 App. Div. 692 (N.Y. App. Div. 1949)

Opinion

March 7, 1949.

Present — Peck, P.J., Dore, Cohn and Shientag, JJ.

We assume that the film in question is not a news film. We do not pass upon the sufficiency of the alleged cause of action, but think that, under the circumstances of this case, the motion for a temporary injunction was properly denied. Orders unanimously affirmed, with $20 costs and disbursements.
