On March 25, 2024, the Court held a telephone conference call with the parties explaining that one of the Low Income Taxpayer Clinics ("LITC's") might be able to assist Ms. Shomo in either settling the case or responding to the motion for summary judgment. Ms. Shomo stated that she would appreciate receiving the assistance of one of the clinics, and that, if given the opportunity, she would appear at a New York City trial session to meet with LITC personnel who would attend that session on June 3, 2024. In our conference call and in our subsequent order (Doc. 34), we explained "that if Ms. Shomo should fail to attend the trial session, then the Court would thereafter expect to entertain the Commissioner's motion now pending against her."
On June 3, 2024, this case was called and recalled from the calendar at the New York, New York, trial session. Counsel for respondent appeared and was heard. There was no appearance by or on behalf of Ms. Shomo. It is
ORDERED that, no later than July 8, 2024, the parties shall file a joint status report (or, if that is not expedient, then separate reports) that shall include their recommendations as to a schedule for further proceedings.
