This case was set on the calendar for the remote Trial Session of the Court at Atlanta, Georgia on February 14, 2022. On January 24, 2022, respondent filed with the Court a motion to dismiss for failure to properly prosecute (docket entry no. 9). When this case was called from the calendar on February 14, 2022, both petitioner and respondent appeared and were heard. The parties reported that a basis of settlement had been reached and respondent made an oral motion to withdraw the motion to dismiss for failure to properly prosecute.

Upon due consideration, and for cause more fully appearing in the transcript of the proceeding, it is

ORDERED that respondent's oral motion to withdraw is granted, and the motion to dismiss for failure to properly prosecute, filed January 24, 2022, is withdrawn. 1
