DECISION & ORDER ON MOTION

Motion by the petitioner for leave to appeal to the Court of Appeals from a decision and judgment of this Court dated February 6, 2013, which determined a proceeding pursuant to CPLR article 78, to review a determination of the New York State Liquor Authority dated November 2, 2011. Separate motion by the petitioner, inter alia, to confirm that a stay pursuant to CPLR 5519(e) is, in effect, pending hearing and determination of its motion for leave to appeal to the Court of appeals.

Upon the papers filed in support of the motions and the papers filed in opposition thereto, it is

ORDERED that the motions are denied.
