Sherman v. Manhattan Life Insurance Company

Appellate Division of the Supreme Court of New York, First Department
Jan 30, 1951
278 App. Div. 563 (N.Y. App. Div. 1951)

Opinion

January 30, 1951.

Present — Peck, P.J., Glennon, Dore, Cohn and Van Voorhis, JJ.

Both causes of action are essentially to reach and determine the distribution of the proceeds of a life insurance policy. As a pleading, which is all that is involved in the motion, they are sufficient. The relief which may be given is not a question we are required to pass upon. Order unanimously affirmed, with $20 costs and disbursements.
