AUTOMOBILES AND MOTOR VEHICLES, § 167car turning out from curb, instruction. Where plaintiff, a police officer riding on a motorcycle, was struck when defendant drove his automobile out of a parking place at the curb without warning, lower court erred in rendering judgment for defendant, and instruction that defendant was not liable if the collision was unavoidable as far as he was concerned, was erroneous.

Appeal from Circuit Court of Cook county; Hon. PAUL A. JONES, presiding.

Reversed and remanded. Heard in first division, first district, this court at October term, 1940.
