In Sherburne v. Taft (49 N.Y. St. Repr. 771; affd., 58 id. 674), an action for an accounting, where to induce a breach of trust an agreement had been made to share in the profits arising thereby, the trial judge in dismissing the complaint said: "Upon its appearing * * * that the agreement * * * was an illegal agreement * * * the law will not aid any of the parties * * * but leave the parties where it finds them.
