Opinion

No. ED77544

Filed: January 30, 2001

APPEAL FROM THE CIRCUIT COURT OF MONROE COUNTY, HONORABLE CARROLL M. BLACKWELL

Karl W. Hinkebein, 3402 Buttonwood Drive, APPELLANT Columbia, MO 65201-3724

Jeremiah W. (Jay) Nixon, Attorney General, Linda Lemke, Asst. Attorney General, RESPONDENT, P. O. Box 899, Jefferson City, MO 65102-0899

Before: Lawrence E. Mooney, P.J. and Paul J. Simon and Sherri B. Sullivan, JJ.

ORDER

John Shepherd (Movant) appeals the judgment denying his Rule 29.15 motion for postconviction relief. On appeal, Movant contends that the motion court erred in denying his Rule 29.15 motion for postconviction relief because he was denied effective assistance of counsel in that his appellate counsel failed to assert on direct appeal that the trial court had prejudicially erred in refusing to instruct the jury on self-defense.

We have reviewed the briefs of the parties, the legal file and the record on appeal and no error of law appears. An extended opinion reciting detailed facts and restating principles of law would have no precedential or jurisprudential value. We affirm the judgment pursuant to Rule 84.16(b).
