This case was calendared for trial during the Court's April 15, 2024, Washington, D.C., trial session. On April 8, 2024, respondent filed a Motion to Dismiss for Lack of Prosecution, representing that petitioner had been largely unresponsive to the efforts of respondent's counsel to prepare the case for trial. Later that same day an attorney entered an appearance for petitioner, who had previously been proceeding pro se.
When this case was called from the calendar on April 15, 2024, counsel for petitioner appeared and requested additional time in which to review the case history and filings. The Court granted that request, advising that the case would be re-called on the morning of April 18, 2024. On April 16, 2024, petitioner requested a teleconference to discuss the status of the case. The next day the Court convened a teleconference during which the parties represented that they had reached a tentative basis of settlement resolving all issues. They requested a continuance to enable them to finalize their prospective settlement.
In consideration of the foregoing, it is
ORDERED that the Motion to Dismiss for Lack of Prosecution, filed April 8, 2024, is denied at this time as moot. It is further
ORDERED that this case is stricken from the Court's April 15, 2024, Washington, D.C., trial session and is continued. The case will not be re-called during this trial session and the parties need not appear on April 18. It is further
ORDERED that jurisdiction of this case is retained by the undersigned. It is further
ORDERED that, on or before June 17, 2024, the parties shall submit decision documents or file a joint status report detailing the then-present status of the case.
This Order constitutes official notice of its contents to the parties.
