Mohammad Rameel Sheikh v. SCF RC Funding IV LLC

Trial court: 270th District Court of Harris County Case Number: 2021-56085

ORDER

AMPARO GUERRA JUDGE

On March 5, 2024, Azhar Chaudhary and Allen D. Russell filed a "Joint Motion to Withdraw and Substitute Counsel for Appellant," requesting that Chaudhary be permitted to withdraw and Russell be substituted as counsel of record in this appeal. According to the motion, appellant "consents] to the withdrawal . . . [and] approves of the substitution."

The motion, however, does not confirm that "the withdrawing attorney" complied with the delivery requirements set forth in Texas Rule of Appellate Procedure 6.5. Specifically, the motion does not confirm that Chaudhary, as the withdrawing attorney, "delivered [the motion] to [appellant] in person or [by] mail[]-both by certified and by first-class mail-to the party's last known address." Tex.R.App.P. 6.5(d). Because the motion fails to comply with the requirements of Rule 6.5(d), the motion is denied. However, nothing in this order prevents the filing of a renewed request for substitution of counsel in compliance with the Texas Rules of Appellant Procedure.

It is so ORDERED.
