December 22, 1942.

Present — Lazansky, P.J., Carswell, Johnston, Adel and Close, JJ.


Action to recover damages for personal injuries suffered by an infant-plaintiff, on a public bathing beach maintained by defendant City, when he was knocked down by a player in a ballgame which was permitted in violation of a rule of the defendant. Companion action by the infant's father to recover for expenses and loss of services. Judgment for the plaintiffs unanimously affirmed, with costs. No opinion.
