YOLANDA SHATTEN, Petitioner v. COMMISSIONER OF INTERNAL REVENUE, Respondent

ORDER

Joseph W. Nega Judge

This case is calendared for trial at the session of the Court to be conducted in person, commencing Monday, September 19, 2022, in Columbia, South Carolina.

On August 12, 2022, respondent filed a Motion to Dismiss for Lack of Prosecution.

On August 29, 2022, petitioner filed a Response to Motion to Dismiss for Lack of Prosecution. That response is improper in that it appears that a document feeder distortion error occurred. Furthermore, attached to petitioner's Response to Motion to Dismiss for Lack of Prosecution is a Proposed Stipulated Decision for the case at docket No. 16484-22S, a case different than the instant case.

Accordingly, it is

ORDERED that the petitioner's Response to Motion to Dismiss for Lack of Prosecution filed August 29, 2022, at Docket Entry No. 011 is hereby stricken from the record in this case. It is further

ORDERED that, on or before September 9, 2022, the petitioner shall file a revised Response to Motion to Dismiss for Lack of Prosecution filed August 29, 2022.
