Opinion

No. 1D21-0270

07-29-2021

Robert SHARP, Petitioner, v. STATE of Florida, Respondent.

Robert Sharp, pro se, Petitioner. Ashley Moody, Attorney General, Tallahassee, for Respondent.

Robert Sharp, pro se, Petitioner.

Ashley Moody, Attorney General, Tallahassee, for Respondent.

Per Curiam.

In this mandamus petition, docketed January 25, 2021, Petitioner seeks review of the "Order on Defendant's Motion to Withdraw Plea" rendered June 18, 2019. Because this order is reviewable by plenary appeal, the Court treats the petition as a notice of appeal. However, as this appeal was not timely commenced, this cause is dismissed for lack of jurisdiction. See Fla. R. App. P. 9.110(b) ; Fla. R. App. P. 9.140(a).

B.L. Thomas, M.K. Thomas, and Long, JJ., concur.
