ORDER MODIFYING OPINION AND DENYING PETITION FOR REHEARING; NO CHANGE IN JUDGMENT

The opinion filed on July 29, 2011, is hereby modified as follows:

On page 9 of the slip opinion, delete the second sentence of the Disposition beginning with "Sharon is entitled to recover her costs. (Cal. Rules of Court, rule 8.278(a)(1)" and the following sentence is inserted in its place:

In the interests of justice, no party shall recover its costs. (Cal. Rules of Court, rule 8.278(a)(5).

Appellant's petition for rehearing is DENIED. This modification does not change the judgment.
