DECISION & ORDER ON MOTION

Motion by respondent to dismiss as untimely an appeal from an order of the Civil Court of the City of New York, Queens County, entered September 10, 2014.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED, on the court's own motion, that the notice of appeal from the order of the Civil Court entered September 10, 2014 is deemed a valid notice of appeal from an order of the same court entered November 24, 2014, made upon reargument (see CPLR 5520 [c]); and it is further,

ORDERED that respondent's motion is denied.
